LITIGATION
If the pre-litigation settlements were unsuccessful, then we are heading to litigation by preparing and filing a complaint to start a lawsuit. Once the complaint is filed, we will have to personally serve the Complaint with a process server. The service stage can take a few months depending on the location of the defendants. After being served, the defendants of the lawsuit will file an answer within 30 days of service and usually deny the allegations of the Complaint. After this, we will begin discovery which is the process that allows us to get answers to questions, receive case-related documents, and interrogate witnesses and the at-fault party. However, the other parties will be able to the same to you. We will work with you to make sure that all discovery requests are completed and done correctly. You will be meeting and working with the attorney regularly during this process. Most cases end up settling in mediation. Mediation is where a third-party attorney will listen to all parties in the case and try to come to a resolution. If mediation is unsuccessful then we will prepare for trial. TRIAL AND RESOLUTION
Trial is very different than what you have a seen in TV. Also, trial is very rare for most personal injury cases.
